These Terms of Use are the contract between you and REMI LTDA, registered under CNPJ 69.610.522/0001-01, which operates Remi ("Remi" or "we"). Please read them carefully before using the app.
Introduction
These Terms of Use govern your use of the Remi app, the remifitness.com website and related services. They are Remi's only terms of use: the version published on this page is the one in force, and the app opens this same page. By creating an account, accessing or using Remi, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use Remi.
These Terms of Use are governed by the laws of the Federative Republic of Brazil. When you use Remi as a consumer, the Brazilian Consumer Defense Code applies and prevails over anything in these Terms of Use that conflicts with it.
Eligibility and Minimum Age
You must be at least 13 years old to create an account. Users aged 13 to 17 need the consent and supervision of a parent or guardian. We will remove accounts of users under 13 if we identify them.
To buy or sell routines, you must be 18 or older. To use professional features (such as CREF verification), you must hold the corresponding license in good standing.
Using Remi
Remi is a fitness and community app built to help you train and track your progress. You agree to use it only for lawful purposes and in line with these Terms of Use, and not to attempt to bypass technical limits, reverse engineer it, overload our infrastructure, automate access without authorization, or interfere with other people's use of it.
Accounts
To use Remi, you must create an account with accurate, up-to-date information. You are responsible for the security of your account and for all activity under it. Let us know immediately if you suspect unauthorized use.
You can delete your account at any time at Settings › Account Preferences › Delete Account. Deletion is permanent, cancels a Premium subscription paid by card, and follows what the Privacy Policy says about deletion and retention.
User Content
You keep all rights to the content you post on Remi (routines, posts, comments, videos, photos and messages). By posting content, you grant Remi a worldwide, non-exclusive, royalty-free, revocable license to host, display, distribute and technically adapt that content, only to the extent needed to operate and promote the service.
When you sell a routine, this license also lets Remi deliver it, with the updates you publish, to the people who bought it, and keep it available to them after you stop selling it or delete it (sections 9 and 10).
You represent that you hold all rights needed for what you post and that it does not infringe anyone else's rights. We may remove content that breaks these Terms of Use.
Community Conduct
You may not use Remi to: harass, bully, threaten or post hate speech; share illegal, sexually explicit, violent or deceptive content; run scams, spam or fraud; infringe copyright or intellectual property; try to access other users' accounts; collect data about other users without consent; use another person's live activity or location to follow, find or monitor them; or impersonate others. Violations may lead to content removal, temporary suspension or permanent account termination.
Health and Fitness Disclaimer
Remi is a training tracker and is not a substitute for professional medical advice, diagnosis or treatment. Consult a healthcare professional before starting a new exercise program, especially if you have pre-existing conditions, are pregnant or are a minor. You assume the inherent risks of physical exercise. Remi is not responsible for injuries, losses or damages resulting from activities suggested in the app.
This disclaimer also covers AI-built routines and meal plans, and routines created by other users, including the ones you buy.
Body reading is optional and produces general training observations from photos you submit. Those observations are not medical advice, diagnosis or treatment, do not estimate body composition and do not change your calorie or macro targets. A posture observation is not a clinical finding, and nothing here replaces assessment by a healthcare professional or a qualified trainer. If you have pain, an injury or a pre-existing condition, consult a qualified professional before following any training suggestion.
Buying a Routine
Some community routines are sold by the users who created them ("authors"). In these sales, Remi provides the platform, the storefront and the billing, and acts as an intermediary: the seller of the routine is its author. During the pilot, buying routines may be available only to selected accounts.
- Payment: you pay once, by credit card or PIX, and the payment is processed by Asaas. When you pay, the amount is split between the author and Remi (section 10).
- What you get: a personal, non-exclusive, non-transferable license to use the routine in Remi for your own training, including the updates the author publishes to it. You may not copy, resell, redistribute or publish the routine's content, in Remi or anywhere else.
- If the routine stops being sold: if the author removes the routine's price, you keep it, along with the updates they publish. If the author deletes the routine, you keep it, and its days and the order of its workouts stop changing. The workouts inside it, however, are still the author's: if they edit or delete one of those workouts, the change shows up for you too. A routine removed for breaking these Terms of Use may stop being available to the people who bought it.
- Content: the routine's content is the author's responsibility. Remi does not guarantee results, and the health disclaimer in section 7 also applies to routines you buy. If a routine breaks these Terms of Use, write to support@remifitness.com.
- Right of withdrawal: you can withdraw from the purchase within 7 days of paying, under article 49 of the Brazilian Consumer Defense Code, by writing to support@remifitness.com. The amount is refunded through the same payment method, and your access to the routine is removed.
- Other refunds: we also review refund requests when a routine does not match what was advertised or when you were charged in error.
- Disputes: if a payment is disputed with the card issuer (chargeback), access to the routine is removed as soon as the dispute is opened. If the dispute is decided in Remi's favor, we restore your access.
Selling a Routine
Premium subscribers aged 18 or older can set a price on the routines they create and sell them to other users. During the pilot, selling routines is available only to selected accounts. By selling, you accept the rules in this section.
Payout account
- To sell, you open a payout account in the app, under Get paid. It is an Asaas account opened in your name with the details you provide: name or company name, CPF or CNPJ, date of birth (for a CPF) or company type (for a CNPJ), email, mobile phone, address and monthly income or revenue.
- You confirm these details are true and yours, and you accept Asaas's terms of use. Asaas reviews the account, may ask for documents, and emails you to activate it.
- You can set a price on a routine as soon as you open your payout account, but the routine can only be bought once Asaas approves your account. If Asaas rejects the account, your routines cannot be sold.
Price, split and payout
- A routine's price can range from R$ 9.90 to R$ 9,999.99.
- You receive 70% of the price the buyer pays, and Remi keeps 30%. Asaas's fees for processing each payment and the cost of opening your payout account are paid by Remi, out of its share.
- Your share goes straight to your Asaas account when the buyer pays, without passing through Remi's account. It becomes available on Asaas's schedule: a credit card payment, for example, becomes available about 32 days after it is confirmed.
- Your balance and withdrawals live in your Asaas account, which you access through the Asaas app or website; there are no withdrawals through Remi. In Remi, you can follow your sales and how much each routine earned.
- When a sale is refunded (including under the right of withdrawal) or disputed, your share of that sale is reversed from your Asaas account. By selling, you authorize that reversal.
What you can sell
- Only routines you created yourself, built from workouts you created. AI-generated routines, imported routines, and routines copied from someone else cannot be sold.
- The routine must match what you advertise and may not promise guaranteed results or the cure or treatment of any disease, or break section 6 or anyone else's rights.
- If you present yourself as a physical education professional, complying with your professional council's rules is your responsibility.
Premium, taxes and stopping
- If your Premium subscription ends, routines already on sale stay on sale at the same price. To price a new routine or change a price, you need Premium.
- What you receive is your own income: declaring it and paying the taxes on it is your responsibility. Remi is only responsible for the taxes on the share it keeps.
- You can stop selling a routine at any time, by removing its price or deleting it; people who already bought it keep it (section 9). Buyers keep using the workouts in a routine they bought even after you delete the routine, so do not delete or empty those workouts. We may take a routine off sale or end your ability to sell if these Terms of Use are broken, fraud is suspected, or the law requires it.
Remi's Intellectual Property
The Remi name, brand, logo, design, source code and other materials of the app and website belong to REMI LTDA and are protected by copyright, trademark and other applicable laws. This section does not affect your rights over the content you create (section 5).
Limitation of Liability
To the maximum extent permitted by applicable law, Remi is not liable for indirect, incidental, special or consequential damages, or lost profits, arising from the use of, or inability to use, the service. This limitation does not exclude liabilities that cannot be limited by law (such as willful misconduct, gross negligence, or consumer rights under the Brazilian Consumer Defense Code). Remi's total liability in any case is limited to the total you paid in Remi (subscriptions and purchases) in the 12 months before the event that caused the damage.
Privacy
The Privacy Policy describes how we collect, use, share and protect your data, including payment data and the payout account details of people who sell. By using Remi, you acknowledge that you have read it.
Suspension and Termination
We may suspend or terminate your account, with or without notice, for breach of these Terms of Use, suspected fraud, misuse, or risk to other users' safety. You can stop using Remi at any time by deleting your account. After termination, your access ends immediately; the sections on intellectual property, limitation of liability and jurisdiction remain in force.
If you sell routines, sales already made, reversals and tax records remain governed by section 10 and the Privacy Policy after termination.
Governing Law and Jurisdiction
These Terms of Use are governed by Brazilian law. For consumer users in Brazil, the courts of the consumer's place of residence have jurisdiction. In all other cases, the courts of the city of Curitiba/PR, Brazil, where the company has its seat, have jurisdiction. Before starting any legal action, you agree to first try to resolve the issue through our support at support@remifitness.com.
Changes to These Terms of Use
We may change these Terms of Use. For relevant changes, we will notify you in the app or by email before they take effect. The version published on this page is always the one in force, and continuing to use Remi after a change means you accept the new version. The last-updated date is shown at the top of this page.
